Abstract:
The aim of the research is to know the practice of enforcement of investment land lease agreement in Motta town in line with investment laws, urban land laws. The study is empirical legal research design and qualitative approach which analysis the law and the practice by using primary and secondary sources through data collection methods. Thus, the researcher examines the enforcement of investment lands in Motta town and tries to analysis it in accordance with investment related laws and urban land lease laws. The finding shows that there is a practical problem in the provision of investment lands for investors in the Motta town which needs the cooperation of all stakeholders. Up on the provision of investment lands to investors there is a stringent issue which is the conclusion of lease contract with appropriate body having the power to administer urban lands which has a problem in Motta town. In addition of urban land lease laws and investment related laws all rights and duties of the lessor and the lessee emanated from the lease contract, so the formation of lease contract shall be made carefully with help of legal experts The enforcement of investment land lease agreement has a problem of lack of cooperation between enforcing organs, lack of commitments from appropriate bodies, investors are reluctant to obey investment land lease agreements and appropriate body does not work to fulfill needed infrastructures for investment areas. As a result, the researcher recommends all concerned body shall work together, the conclusion of lease contract shall be made carefully, enforcing organ shall work in full commitment to take legal measurements and investors shall obey their investment land lease agreements and they shall give their fruit what the town pursuit from its investor.
