Abstract:
The protection of intellectual property, particularly through patents, remains a critical instrument for stimulating research, development, and innovation (RDI) within national economies. This study critically analyses the impact of patent protection on RDI in Nigeria, drawing comparative insights from India's experience with intellectual property reform and innovation-driven growth. The research adopts a doctrinal and comparative legal methodology, examining relevant statutes, case law, and policy frameworks in both jurisdictions. It interrogates the extent to which Nigeria's current patent regime promotes technological advancement, incentivizes research activities, and facilitates knowledge transfer. Findings reveal that Nigeria's patent system is characterized by weak institutional enforcement, limited public awareness, and inadequate integration of intellectual property policy into national development strategies. In contrast, India's adoption of flexible patent mechanisms, particularly in the pharmaceutical and technology sectors, demonstrates how a balanced approach between intellectual property protection and public interest can foster local innovation and attract foreign investment. The study concludes that Nigeria can enhance its innovation ecosystem by reforming its patent laws, strengthening institutional capacity, and aligning its intellectual property framework with broader economic and scientific development goals.
